Welcome to Chhar ("we", "our", "us"). By accessing or using the Chhar mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully before using the App.

1. Acceptance of Terms

By downloading, installing, or using the Chhar App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 13 years of age to use the Chhar App. By using the App, you represent and warrant that you meet this age requirement. Users under 18 should have parental or guardian consent.

3. Description of Service

Chhar is a discount and deal discovery platform that helps users in Bangladesh find offers, promotions, and deals from various stores and brands. The App provides two primary modes of use:

  • Consumer Mode: Browse and discover deals, search for stores, and find nearby offers.
  • Business Mode: Create and manage a store profile, add branches, and publish discount offers that are visible to all App users.

We aggregate and display information provided by third-party merchants, retailers, and business owners who use the App.

4. Account Registration

  • You are required to provide your mobile phone number and complete OTP (one-time password) verification to create an account.
  • You may be asked to provide additional personal information (name, email, gender, location) to complete your profile.
  • You are responsible for maintaining the confidentiality of your account and the security of the device where your authentication token is stored.
  • You agree to provide accurate and complete information during registration and to keep it updated.
  • You are solely responsible for all activity that occurs under your account.

5. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the App in any way that violates applicable local, national, or international law.
  • Attempt to gain unauthorized access to the App, other accounts, or any related systems.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the App without express written permission.
  • Use automated scripts or bots to access or interact with the App.
  • Transmit any malicious code, viruses, or harmful data.
  • Circumvent rate limits, authentication mechanisms, or other security measures.

6. Business Mode

6.1 Becoming a Store Owner

Any registered user may activate Business Mode to create a store profile. No separate registration or approval is required. By creating a store, you agree to the additional terms in this section.

6.2 Store Content and Accuracy

As a Business Mode user, you are solely responsible for:

  • The accuracy, completeness, and legality of all store information, branch details, and discount offers you publish.
  • Ensuring that discount offers, promo codes, and redeem links are valid and honored as described.
  • Ensuring that uploaded images (logos, cover photos, offer images) do not infringe on any third-party intellectual property rights and do not contain inappropriate or illegal content.

6.3 Public Visibility

All store profiles, branches, and discount offers you create through Business Mode are immediately visible to all App users through the public feed, store listings, and nearby store search. You acknowledge and consent to this public visibility when creating content.

6.4 Content Removal

We reserve the right to remove or disable any store, branch, or discount offer that:

  • Violates these Terms or applicable law.
  • Contains false, misleading, or deceptive information.
  • Infringes on intellectual property or other rights of third parties.
  • Contains inappropriate, offensive, or harmful content.

6.5 Store Deletion

You may permanently delete your store at any time through the App. Deleting a store removes all associated branches, discount offers, and uploaded images immediately and irreversibly.

6.6 Image Uploads

Images uploaded through Business Mode (logos, cover photos, offer images) must be in JPEG or PNG format and must not exceed 5 MB. Uploaded images are stored on cloud servers and are publicly accessible. You represent that you have the right to upload and publish all images you submit.

7. Discounts and Deals

  • Chhar displays deals and discount information sourced from third-party merchants and from Business Mode store owners. We do not guarantee the accuracy, availability, or validity of any deal or offer shown in the App.
  • Deals may expire, change, or be withdrawn by the merchant or store owner at any time without notice.
  • Chhar is not a party to any transaction between you and the merchant or store owner. Any disputes regarding deals, purchases, or services must be resolved directly with the respective party.
  • We are not responsible for any loss or damage arising from your reliance on deal information displayed in the App.

8. Intellectual Property

  • All content in the App, including but not limited to text, graphics, logos, icons, images, and software, is the property of Chhar or its content suppliers and is protected by Bangladesh and international copyright, trademark, and other intellectual property laws.
  • You may not reproduce, modify, distribute, or create derivative works from any content without prior written consent.
  • Content created by Business Mode users (store profiles, offer details, uploaded images) remains the intellectual property of the respective user, with a license granted to Chhar as described in Section 9.

9. User Content

  • By submitting any content (store profiles, branch information, discount offers, uploaded images, reviews, feedback, or other material) through the App, you grant Chhar a non-exclusive, royalty-free, worldwide license to use, display, distribute, and make available such content within the App and related services.
  • You represent that you own or have the necessary rights to submit such content and that it does not violate the rights of any third party.
  • You retain ownership of your content and may remove it at any time by deleting the associated store, discount, or account.

10. Account Deletion

  • You may delete your account at any time through the App. Account deletion requires OTP verification for security.
  • Upon account deletion, your personal profile data will be removed. If you have a Business Mode store, it must be deleted separately before or will be removed along with your account.
  • Account deletion is permanent and cannot be reversed.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Chhar is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free from harmful components.
  • We do not warrant the accuracy or reliability of any deal, discount, store information, or content published by Business Mode users.
  • In no event shall Chhar, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

13. Indemnification

You agree to indemnify and hold harmless Chhar, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of:

  • Your use of the App or violation of these Terms.
  • Content you submit or publish through Business Mode.
  • Any dispute between you and another user or merchant.

14. Termination

  • We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause and with or without notice.
  • We may remove any store, branch, or discount content that violates these Terms.
  • Upon termination, your right to use the App ceases immediately.
  • Provisions that by their nature should survive termination shall remain in effect.

15. Modifications to Terms

We may revise these Terms at any time by updating this page. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. We encourage you to review the Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh.
